Acceptable Use Policy

Effective Date: April 16, 2026

This Acceptable Use Policy (“AUP”) governs access to and use of the Project DIAMOnD Infrastructure and is incorporated by reference into the Project DIAMOnD® Infrastructure Terms of Service (“Terms”). Capitalized terms not defined in this AUP have the meanings assigned in the Terms.

1) Scope

This AUP applies to all individuals and entities that accessor use the Project DIAMOnD Infrastructure, including:

This AUP does not govern the operation of third-party platforms used for marketplace transactions, manufacturing, fulfillment, or payment processing. Those activities are governed by the applicable third-party terms and policies.

However, participation in the Project DIAMOnD program, including access to marketplace functionality, remains subject to Project DIAMOnD program rules, eligibility requirements, and program-level oversight as described in the Terms.

2) General Use Requirements

You must use the Project DIAMOnD Infrastructure:

You are responsible for all activity conducted through your account and for ensuring that individuals acting on your behalf comply with this AUP.

3) Prohibited Conduct

You may not engage in any of the following when using the Project DIAMOnD Infrastructure:

A. Unlawful, Fraudulent, or Deceptive Activity

B. Restricted, Sensitive, or Regulated Content

C. Security and System Integrity

D. Community and Academy Misuse

4) Export Control and Compliance Obligations

You are solely responsible for ensuring that your participation in the Project DIAMOnD program complies with applicable export-control, sanctions, and trade laws.

The Project DIAMOnD Infrastructure is not authorized for the storage or handling of export-controlled technical data unless expressly approved in writing by Project DIAMOnD. Marketplace uploads and manufacturing activities occur on third-party platforms and are governed by those platforms’ terms.

5) Public Funding, Eligibility, and Compliance Obligations

Because certain Project DIAMOnD activities are supported by public funds:

Project DIAMOnD does not undertake a general obligation to monitor user activity. However, consistent with its program-level oversight obligations, Project DIAMOnD reserves the right to:

Failure by Project DIAMOnD to enforce this AUP in any particular instance does not constitute a waiver of its right to enforce this AUP or the Terms in the future.

9) Changes to this AUP

Project DIAMOnD may update this AUP from time to time. Material changes will be posted on the Project DIAMOnD Infrastructure with an updated effective date. Continued use of the Project DIAMOnD Infrastructure after the effective date constitutes acceptance of the revised AUP, except to the extent otherwise prohibited by law.

10) Relationship to Other Terms

This AUP supplements the Project DIAMOnD Infrastructure’s Terms of Service and Privacy Policy. In the event of a conflict, the Project DIAMOnD’s Terms of Service control.
