Acceptable Use Policy

Effective Date: April 16, 2026

This Acceptable Use Policy (“AUP”) governs access to and use of the Project DIAMOnD Infrastructure and is incorporated by reference into the Project DIAMOnD^® Infrastructure Terms of Service (“Terms”). Capitalized terms not defined in this AUP have the meanings assigned in the Terms.

1) Scope

This AUP applies to all individuals and entities that accessor use the Project DIAMOnD Infrastructure, including:

• Onboarding and identity or business verification;
• Account and profile administration;
• Project DIAMOnD-hosted community and academy features (including those technically hosted by third-party service providers on Project DIAMOnD’s behalf);
• Project DIAMOnD-hosted pages, communications, and navigation tools.

This AUP does not govern the operation of third-party platforms used for marketplace transactions, manufacturing, fulfillment, or payment processing. Those activities are governed by the applicable third-party terms and policies.

However, participation in the Project DIAMOnD program, including access to marketplace functionality, remains subject to Project DIAMOnD program rules, eligibility requirements, and program-level oversight as described in the Terms.

2) General Use Requirements

You must use the Project DIAMOnD Infrastructure:

• In compliance with all applicable federal, state, and local laws and regulations, including export-control, sanctions, and data-protection laws;
• In accordance with the Terms, the Privacy Policy, this AUP, and any published Project DIAMOnD program rules;
• In a manner consistent with the Project DIAMOnD program’s role as a publicly supported economic development and innovation program implemented pursuant to applicable grant and funding requirements.

You are responsible for all activity conducted through your account and for ensuring that individuals acting on your behalf comply with this AUP.

3) Prohibited Conduct

You may not engage in any of the following when using the Project DIAMOnD Infrastructure:

A. Unlawful, Fraudulent, or Deceptive Activity

• Violating any applicable law, regulation, or court order;
• Facilitating fraud, misrepresentation, or deceptive practices;
• Circumventing onboarding, verification, eligibility, or compliance requirements.

B. Restricted, Sensitive, or Regulated Content

• Uploading, transmitting, or storing Controlled Unclassified Information (CUI);
• Uploading export-controlled technical data or materials subject to ITAR, EAR, or U.S. sanctions laws;
• Uploading personal data subject to heightened legal protection (including medical, financial, student, or biometric data), unless expressly authorized in writing by Project DIAMOnD.

C. Security and System Integrity

• Introducing malware, ransomware, spyware, or other malicious code;
• Attempting to gain unauthorized access to systems, accounts, or data;
• Interfering with or disrupting the operation or security of the Project DIAMOnD Infrastructure.

D. Community and Academy Misuse

• Harassment, threats, hate speech, or discriminatory conduct;
• Submitting false or misleading certifications, attestations, or representations;
• Engaging in conduct that could jeopardize Project DIAMOnD’s compliance with applicable funding requirements or internal-control obligations.

4) Export Control and Compliance Obligations

You are solely responsible for ensuring that your participation in the Project DIAMOnD program complies with applicable export-control, sanctions, and trade laws.

The Project DIAMOnD Infrastructure is not authorized for the storage or handling of export-controlled technical data unless expressly approved in writing by Project DIAMOnD. Marketplace uploads and manufacturing activities occur on third-party platforms and are governed by those platforms’ terms.

5) Public Funding, Eligibility, and Compliance Obligations

Because certain Project DIAMOnD activities are supported by public funds:

• You may not circumvent eligibility, debarment, suspension, or conflict-of-interest requirements;
• You may not submit false certifications regarding eligibility or compliance (including certifications under 2 CFR Part180);
• You may not engage in conduct that could place Project DIAMOnD in violation of applicable funding conditions, including 2 CFRPart 200.

6) Monitoring and Enforcement

Project DIAMOnD does not undertake a general obligation to monitor user activity. However, consistent with its program-level oversight obligations, Project DIAMOnD reserves the right to:

• Investigate suspected violations of this AUP;
• Remove or restrict access to content hosted on Project DIAMOnD-controlled systems;
• Suspend or terminate access to the Project DIAMOnD Infrastructure;
• Take other actions permitted under the Terms, applicable law, or funding requirements.

Enforcement actions may be taken without prior notice where required for security, legal compliance, or program integrity.

7) Reporting Concerns

Suspected violations of this AUP or misuse of the Project DIAMOnD Infrastructure may be reported to:

8) No Waiver

Failure by Project DIAMOnD to enforce this AUP in any particular instance does not constitute a waiver of its right to enforce this AUP or the Terms in the future.

9) Changes to this AUP

Project DIAMOnD may update this AUP from time to time. Material changes will be posted on the Project DIAMOnD Infrastructure with an updated effective date. Continued use of the Project DIAMOnD Infrastructure after the effective date constitutes acceptance of the revised AUP, except to the extent otherwise prohibited by law.

10) Relationship to Other Terms

This AUP supplements the Project DIAMOnD Infrastructure’s Terms of Service and Privacy Policy. In the event of a conflict, the Project DIAMOnD’s Terms of Service control.
